Partial Finger Amputation After Access To Unguarded Saw

Brief Summary

An employer was prosecuted after a worker reached into an automatic saw to retrieve a cut piece and contacted the moving blade, losing part of a finger. The HSE found the employer had not taken effective measures to prevent access to dangerous moving parts, a breach of Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998. The case underlines the need for effective guarding and safe working methods where machinery is used.

What Was The Incident?

During routine cutting work the operator reached into an automatic saw to remove a cut piece while the machine was running. Their hand contacted the moving saw blade and part of a finger was amputated. The saw allowed access to dangerous moving parts during operation and controls and physical guards did not prevent that access. The HSE investigation concluded the employer had failed to take effective measures to stop people reaching the dangerous parts of the machine.

What Was The Outcome?

The employer pleaded guilty to breaching Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998. The company was fined £20,000, ordered to pay £15,000 compensation to the injured worker and to pay £9,064.34 in prosecution costs. The sentence was handed down at Milton Keynes Magistrates Court on 23 October 2026.

Key Points To Consider

Machine guarding and interlocks. Review whether fixed guards prevent access to moving parts and where access is needed check that interlocked guards or other measures stop dangerous movement before a person can reach the danger zone.

Safe methods for removing cut pieces. Verify written safe work procedures prevent reaching into running machinery, provide tools or devices to remove material safely and require isolation and confirmation that the machine has stopped when hands must enter the area.

Risk assessments inspections and records. Audit risk assessments, pre use checks, maintenance and inspection records to ensure guarding and control measures are in place and documented and that supervisors and operators follow the required checks and procedures.
