Handyman Sentenced for Illegal Boiler Fitting Causing Dangerous Gas Leak
Handyman Sentenced for Illegal Boiler Fitting Causing Dangerous Gas Leak
Brief Summary
An employer hired a self employed handyman to fit a boiler and carry out gas work at a property in Birmingham. The work included multiple defects and resulted in an immediately dangerous gas leak. The handyman was found to have carried out gas work without being competent and without being registered, and pleaded guilty to breaching the Gas Safety regulations. Although no one was injured, the incident shows how illegal and unqualified gas work can create severe risks.
What Was The Incident?
In November 2023, the property tenant observed the handyman carrying out gas work, including installing the boiler. The tenant then found no evidence that the handyman was registered with the Gas Safe Register, despite him claiming he was. A Gas Safe Register inspection was carried out in December 2023 and identified an immediately dangerous gas leak on pipework to the boiler, along with several other possibly dangerous defects. HSE later found that the handyman carried out gas work without being competent and without being registered.
What Was The Outcome?
At Dudley Magistrates Court on 12 June, the handyman pleaded guilty to breaching Gas Safety Installation and Use Regulations 1998, Regulation 3(3). He received a 26 week suspended sentence and was ordered to pay 500 in compensation to the tenant. HSE brought the prosecution and noted that it does not determine sentences, which are set by the court.
Key Points To Consider
Only use Gas Safe registered engineers for gas work. Employers and those arranging work should ensure anyone carrying out gas work is registered, and verify credentials rather than relying on claims.
Illegal gas work creates immediate life risk. Where gas work is carried out without proper registration and appropriate standards, defects can include gas leaks that can be immediately dangerous.
Check competence and standards, not just paperwork. This case also involved findings that the work was carried out without being competent, reinforcing the need for suitably qualified and competent persons.
Act early if you suspect unqualified work. The tenant challenged the registration claim and alerted inspectors, which helped identify serious defects before anyone was injured.
Understand legal duties under gas safety regulations. Breaching the Gas Safety Installation and Use Regulations can lead to criminal prosecution, suspended sentences, and compensation orders, even when no injuries occur.
