Handyman Sentenced for Illegal Boiler Fitting After Dangerous Gas Leak
Handyman Sentenced for Illegal Boiler Fitting After Dangerous Gas Leak
Brief Summary
An employer commissioned an unregistered handyman to install a boiler at a Birmingham property. The work contained multiple defects and caused a gas leak that was assessed as an immediate danger to life, leading to enforcement action and a suspended sentence.
What Was The Incident?
In November 2023, a self employed handyman was hired by the landlords to carry out boiler related gas work at a property in Birmingham. The tenant observed the work being carried out, including the installation of the boiler, and later found no evidence that the handyman was registered on the Gas Safe Register despite claiming otherwise. In December 2023, a Gas Safe Register inspector attended to inspect the gas work and identified an immediately dangerous gas leak on pipework to the boiler and several other possibly dangerous defects. Following this, the HSE investigation found the handyman carried out gas work without being competent and without being registered on the Gas Safe Register.
What Was The Outcome?
The handyman pleaded guilty to breaching the Gas Safety Installation and Use Regulations 1998, Regulation 3(3). He received a 26 week suspended sentence and was ordered to pay 500 in compensation to the tenant. No one was injured, but the enforcement outcome reflected the seriousness of illegal and unsafe gas work.
Key Points To Consider
Only use Gas Safe registered people for gas work. Gas work should only be carried out by individuals who are on the Gas Safe Register, and claims of registration should be verified.
Competence is non negotiable for gas systems. As well as being registered, people carrying out gas work must be competent to do it to the appropriate standards.
Dangers from poor installation can be immediate. Defects such as dangerous gas leaks can create a serious risk of explosion or other harm even if no injury occurs.
Check credentials before authorising work. A simple verification process can help prevent illegal work being carried out, particularly when contractors provide questionable assurances.
Illegal gas work can lead to prosecution and financial penalties. Breaching the gas safety regulations can result in suspended sentences and compensation orders, showing the strong enforcement approach to unregistered gas work.
